The Supreme Court started its March term with the Harper Murder appeal. Meanwhile, one of the defendants, Wonplu Boye, had died. After hearing arguments in the Supreme Court, at the end of April 1978, the Court remanded the case. It ordered a new trial because of the ‘erroneous and illegal’ rulings of the Harper Court and that this new trial be given first preference. It also ordered that the confessions made, because of the ‘illegal and unconstitutional’ manner in which they were obtained, will be excluded from the new trial, and that the defendant who did not appeal to the Supreme Court, Wisseh, would not be tried again.
